2  Updates to local standards primarily to respond to 2015 changes in state statute and rules intended to align medical and recreational marijuana standards and markets in Washington  State changes change authorization for certain medical uses on July 1, 2016  Updated signage provision to respond to evolving caselaw Background Marijuana amendments - 2

3 Citywide Recreational Marijuana Sites Red – Likely eligible for retailers Green Star – Established retailers Orange Star – New retailers Blue – Likely eligible for producer/processors

4  Eliminate VMC 20.883, Medical Marijuana Collective Gardens. These no longer authorized by state law as of 7/1/16, and no local applicants or inquiries received since 20.883 was adopted in 2012.  Add VMC 20.884 language affirming rights of individual medically authorized users to grow or designate a grower pursuant to state law  Add VMC 20.884 language allowing licensed research facilities in IL and IH zones, subject to the 1000 foot buffer Proposed Changes Marijuana amendments - 4

5  Add VMC 20.884 language affirming new state requirement that medical marijuana growing or possession not be smelled or seen from public areas or adjacent private residences.  Eliminate VMC 20.884.030.C prohibition of off-premise signs for marijuana facilities. This prohibition is unique to marijuana in city code, and is problematic in regards to recent caselaw on signage regulations. Proposed Changes (cont.) Marijuana amendments - 5
