2 Oil and Natural Gas: Senate Bill 76  Fiscal note exemption  Requires the General Assembly to take affirmative legislative action to allow the issuance of permits for horizontal drilling and hydraulic fracturing  Requires the MEC to complete additional studies :  Coordinated permitting  Appropriate rate of severance tax  Landman registration  Modifies appointments to the MEC

3 North Carolina Department of Environment and Natural Resources Oil and Natural Gas  S 76 alters appointments to the Energy Policy Council  Moves the Energy Policy Council from Commerce to DENR  The Appropriations Act moved the State Energy Office from Commerce to DENR  State Energy Office staff been transferred into the Division of Energy, Mineral and Land Resources ( DEMLR ) and the Division of Environmental Assistance and Customer Service ( DEACS )

4 North Carolina Department of Environment and Natural Resources Wind Energy  Establishes a permitting system for wind energy facilities  Requires notification of counties and municipalities where wind energy facilities are proposed  DENR is currently working on implementation

5 North Carolina Department of Environment and Natural Resources Water Resources  Division of Water Quality and Division of Water Resources merged  Senate Bill 515 delays implementation of the Jordan Lake Nutrient Management Strategy for 3 years  The Appropriations Act provides funding for a pilot project to test a system that will aerate water in Jordan Lake

6 North Carolina Department of Environment and Natural Resources Stormwater  DENR has moved DWQ ’ s stormwater staff into the Division of Energy, Mineral and Land Resources  House Bill 74 amends the definition of built - upon area to exclude gravel  DENR is currently working on how to advise developers, local governments and others given this change

7 North Carolina Department of Environment and Natural Resources Water Infrastructure  The Appropriations Act creates a new Division of Water Infrastructure in DENR  DWI will manage  Clean Water State Revolving Fund  Drinking Water State Revolving Fund  State loan and grant programs  Manages CDBG infrastructure grants  Budget bill also created the State Water Infrastructure Authority

8 North Carolina Department of Environment and Natural Resources Solid Waste  The Commission for Public Health was directed to amend rules so that vehicles transporting solid waste are no longer required to be leak proof, but must be leak resistant  Executive Order 22 allows Highway Patrol officers to cite solid waste vehicles leaking waste

9 North Carolina Department of Environment and Natural Resources Coastal Management  Senate Bill 151 changes the definition of terminal groin  H 74 amends the CAMA minor permit notice requirements by removing requirement for publication of notice in a newspaper

10 North Carolina Department of Environment and Natural Resources Commissions  The Appropriations Act of 2013 ended the terms of members serving on the Environmental Management Commission and the Coastal Resources Commission  New EMC members have been appointed  CRC appointments should be made soon
