EPA P-1 Institutional Control Tracking EPA Superfund Perspective November 2006

EPA P-2 Presentation Objectives  Background  Benefit of Reuse  Purpose/Need for IC Tracking  IC Tracking Continuum »Identification, Selection and Implementation »Coordination and Effectiveness Evaluations »Long-Term Stewardship and Outreach  Challenges and Opportunities

EPA P-3 What Is An IC According to EPA?  Non-engineered administrative or legal controls that limit land or resource use and/or protect the integrity of a remedy »National Contingency Plan »Unique IC issues

EPA P-4 When are ICs Necessary?  Threshold for ICs »Unlimited use and unrestricted exposure —Site-specific determination —Residential v. UU/UE

EPA P-5 Environmental, Social, and Economic Benefits of Reuse  One acre of infill development preserves 4.5 acres of greenfields  Approximately 375 sites with actual or planned reuse  32,000 on-site jobs  $1.35 billion in income  Over 42,500 acres created, preserved, and restored for recreational and ecological purposes Ecological reuse at the Northwest 58 th Street Landfill in Hialeah, Florida

EPA P-6 IC Tracking Need  Risk base cleanups are a reality »Waste is frequently managed in place »Tailor remediation to use »ICs necessary to help ensure safe future use — help minimize potential for exposure — protect remedy components  ICs have limitations »ICs are not self-actuating »ICs have process-related blind spots and inherent weaknesses  IC reliability can be significantly strengthened through systematic information capture, analysis and exchange

EPA P-7 Designing an IC Tracking System What are you trying to accomplish?

EPA P-8 Identification, Evaluation and Selection  Baseline information » Site Name » Site Location » What ICs were selected » What document selected the ICs » Are the ICs implemented »Is there a Planned or actual implementation date

EPA P-9 Coordination and Effectiveness Evaluations  Specific coordination responsibilities for: »Implementation »Monitoring »Reporting »Enforcement »Termination  Develop Effectiveness Sets »Media »Objective »Instrument

EPA P-10 Baseline Complexity Example

EPA P-11 Recommended Option Reporting Example

EPA P-12 Long-Term Stewardship  Present difficult relationships graphically »Area of concern »Type of IC »Specific restrictions »Where to go for more information

EPA P-13

EPA P-14 IC Tracking Challenges  For Superfund sites, EPA responsible for selecting protective remedies  For Superfund sites, EPA has long-term oversight role at both PRP and fund lead sites  ICs often implemented, monitored, enforced and terminated by State and Local agencies  For Superfund Strong need to coordinate and engage with co-regulators »IC Tracking identified as a critical step  EPA, States, Local Government and others responsible for sites do not all have easy access to the same data

EPA P-15 Data Standard Coordination  Collaborative development process between OSWER programs, other Federal agencies, States, Local governments, NGOs, and non-regulated-industry  IC Data Standard effort was under the Environmental Data Standards Council (lead by EPA/ECOS)  Developed as a cross-program, cross-agency tool  Component-based structure to facilitate data exchange and foster reuse  Flexible design to accommodate future additions to existing lists

EPA P-16 Data Standard Overview  Utilizes XML »Facilitates exchanging data between parties  Consists of XML Schema Definition (XDS) »Defines how IC data should be organized »Modular design to allow for reuse and extensibility »Multiple methods of implementation for cataloging and transferring data

EPA P-17 Data Standard Implementation  Establishes data element relationship to facilitate IC data transfer through: »“Mapping” of data elements from existing tracking systems to the standard »“Adoption of exact data elements from the standard within new or enhanced tracking systems  Information on the standard available though the EDSC website http://www.envdatastandards.net/

EPA P-18 Contact Information  Michael Bellot »703-603-8905 »Bellot.michael@epa.gov
