Institutional Control - Institutional Control - The control and responsibility for the conduct of intercollegiate athletics shall be exercised by the institution itself and by the conference. Administrative control or faculty control, or a combination of the two, shall constitute institutional control. Athletics is part of the institution It is not permitted to be a stand-alone or autonomous entity of the institution It is vital that departments and staff outside the athletic department have responsibilities and safeguards regarding funding, financial aid, admissions, eligibility certification, additional student support services FINALLY, It is required by ABOR!!!!

6. What is the NCAA? The NCAA stands for the National Collegiate Athletic Association. It is membership organization designed to regulate itself. All rules/bylaws are created by the member institutions with equal representation (sort of).

14. How Long is a Student-Athlete Eligible? Div-I: 5 years from when you enroll full-time in a 2 or 4 yr. institution after HS. The clock automatically starts after you turn 21

16. Types of Violations Secondary – is isolated or inadvertent in nature, provides or is intended to provide only a minimal recruiting, competitive or other advantage and does not include any significant recruiting inducement or extra benefit. Two types: Level I – more serious Level II – less serious Major – Systemic problem with a “lack of institutional control” generally providing an extensive recruiting or competitive advantage.

17. Penalties for Secondary Violations Enforcement staff can impose appropriate penalties using case precedent. Any penalty imposed by the staff is the “minimum threshold” penalty for that violation. THIS MEANS-Institutions and conferences have the authority to impose more significant penalties than the NCAA minimum.

Guidelines for Penalties The penalty should affect the area in which it occurred (e.g., a recruiting violation should result in a recruiting penalty); The penalty should be designed to affect the individual responsible for the violation and/or that individual’s sport program; A penalty should be imposed over and above just eliminating the advantage (2-for-1).

19. 2 for 1 Reduction Facts: A member of the coaching staff telephones a prospective student-athlete on two occasions during the same one-week period (Bylaw 13.1.3.1). Penalty: The institution should be required to preclude the coaching staff from telephoning the prospective student-athlete for a period of two weeks (twice the number of weeks as the number of impermissible calls that occurred – a 2-for-1 reduction).

21. Why is self-reporting important? It is an efficient and effective way to handle secondary violations. It is REQUIRED! NCAA constitution 2.8.1 mandates that institutions report all instances of noncompliance with NCAA rules and regulations.

Proposal No. 2007-21 AMATEURISM -- GENERAL REGULATIONS -- EDUCATIONAL EXPENSES -- PRIOR TO COLLEGIATE ENROLLMENT -- PERMISSIBLE EXPENSES OR SERVICES Expands educational expenses or services that may be provided to PSA’s beyond tuition, fees, room and books (e.g., tutoring, test prep classes). Still not from an agent, professional team/ organization or booster. Payment directly to source of expense or service. Effective: Immediate.

Proposal No. 2007-16-B PERSONNEL AND RECRUITING -- LIMITATIONS ON THE NUMBER AND DUTIES OF COACHES -- RECRUITING COORDINATION FUNCTIONS -- PREPARATION OF GENERAL RECRUITING CORRESPONDENCE Preparation of general recruiting correspondence is no longer a recruiting coordination function. All institutional staff members may prepare general correspondence. Effective: August 1, 2008.

Proposal No. 2007-45 RECRUITING -- PRINTED RECRUITING MATERIALS -- EXPRESS MAIL SERVICES -- PRE-ENROLLMENT INFORMATION Necessary pre-enrollment information may be sent to PSA via express mail delivery services. Only after NLI or financial aid agreement has been signed or PSA has been accepted for enrollment. Effective: Immediate.

Proposal No. 2007-59 ELIGIBILITY -- CERTIFICATION OF ELIGIBILITY -- INSTITUTIONAL RESPONSIBILITY -- DE MINIMIS VIOLATION When institution fails to certify SA's eligibility prior to SA participating in intercollegiate competition: Institutional violation. Does not affect SA's eligibility. Provided all necessary information was available and the SA would have otherwise been eligible. Effective: Immediate.

Proposal No. 2007-63 ELIGIBILITY -- FRESHMAN ACADEMIC REQUIREMENTS -- ELIGIBILITY FOR FINANCIAL AID, PRACTICE AND COMPETITION -- QUALIFIER -- EXCEPTION -- EARLY ACADEMIC CERTIFICATION Early certification as a qualifier after six semesters (or the equivalent) based on: 1000 SAT or 85 ACT; and 3.000 GPA in 13 core courses Three English. Two math. Two science. Six additional in a core area. Effective: August 1, 2008; applicable for certifications for fall 2008.

Proposal No. 2007-65 ELIGIBILITY -- PROGRESS- TOWARD-DEGREE REQUIREMENTS -- BONA FIDE FOREIGN EXCHANGE STUDENT EXCEPTION Eligibility for competition of a bona fide foreign exchange student shall be based on satisfactory completion of at least: Six hours during the preceding full-time term; 18 semester or 27 quarter hours per regular academic year; and Minimum GPA per academic term of enrollment as required for regularly enrolled SA’s. Effective: August 1, 2008.

Proposal No. 2007-66 (as amended by 2007-66-1) ELIGIBILITY -- TWO-YEAR COLLEGE TRANSFERS -- NONQUALIFIERS -- TRANSFERABLE ENGLISH AND MATH 2-4 transfers must successfully complete: –Six semester or eight quarter hours of transferable English. –Three semester or four quarter hours of transferable math. Effective: August 1, 2009; for SA initially enrolling full time in a collegiate institution on or after August 1, 2009. Already in effect for the BSC.

Proposal No. 2007-82 AWARDS, BENEFITS AND EXPENSES -- BENEFITS, GIFTS AND SERVICES -- COACHING AND ATHLETICS ADMINISTRATION CAREER EDUCATION PROGRAMS Institution or conference may provide actual and necessary expenses for coaching and athletics administration career educational programs. SA must have completed third year (sixth semester or ninth quarter) of collegiate enrollment. Effective: August 1, 2008.

Proposal No. 2007-83 PLAYING AND PRACTICE SEASONS -- TIME LIMITS FOR ATHLETICALLY RELATED ACTIVITIES -- EXCEPTION -- ELIGIBILITY EXHAUSTED Student-athlete who has exhausted eligibility in a sport but is eligible for practice under the five-year rule, is not subject to the time limitations for athletically related activities. Effective: August 1, 2008.

Proposal No. 2007-98 CHAMPIONSHIPS AND POSTSEASON FOOTBALL -- ELIGIBILITY FOR CHAMPIONSHIPS -- GENERAL INSTITUTIONAL REQUIREMENTS -- RACE AND GENDER DEMOGRAPHIC INFORMATION Institution must annually submit its race and demographic information to the NCAA in order to be eligible to enter a team or individual in NCAA championship competition. Effective: Immediate.

Proposal No. 2007-104 ACADEMIC PERFORMANCE PROGRAM -- PENALTIES AND REWARDS -- PROGRESSION OF PENALTIES -- POSTSEASON COMPETITION -- INDIVIDUAL SPORTS SA on an individual sport team that is ineligible for postseason competition due to a penalty pursuant to the academic performance program shall not compete in postseason competition, including NCAA championships, as an individual. Effective: August 1, 2008.
