4 U.S. Army Corps of Engineers Performing unauthorized work in waters of the United States is a violation of Federal law with potentially stiff penalties including fines and/or requirements to restore the area and/or imprisonment. Enforcement is an important part of the Corps' regulatory program. Corps' surveillance and monitoring activities are often aided by various agencies, groups, and individuals who report suspected violations. When in doubt as to whether a permit is needed, contact the nearest Corps' regulatory office. Doing so may save a lot of unnecessary trouble later. Failure to comply with the terms of an issued permit may also carry heavy penalties. Wetland Conservation Act State Rule 8420.0900 Enforcement Procedures Cease and desist order Restoration order If violated it is misdemeanor that must be prosecuted by the county attorney. 9 USACE General Condition: #3 If you discover any previously unknown historic or archaeological remains while accomplishing the activity authorized by this permit, you must immediately notify this office of what you have found. We will initiate the Federal and state coordination required to determine if the remains warrant a recovery effort or if the site is eligible for listing in the National Register of Historic Places. USACE Special Condition: #1 To avoid additional impacts to wetlands not authorized by this permit, you shall place and maintain during construction visible silt fencing and/or bright construction stakes on the construction limit boundary at areas where remaining wetlands are located to demarcate these work areas through the existing US 53 corridor and the E-2 alignment.

10  A LEVEL 2 WETLAND DELINEATION WAS COMPLETED FOR THE PROJECT, ANO IS REPRESENTED IN THE CONSTRUCTION PLANS. THE CONTRACTOR IS REQUIRED TO SUBMIT SPECIFIC SITE MANAGEMENT PLANS FOR ALL WORK OCCURING ADJACENT TO EXISTING WETLANDS.  STAGING AREAS - THE CONTRACTOR SHALL LOCATE STAGING AREAS IN UPLAND AREAS AWAY FROM JURISDICTIONAL FEATURES (E.G.WETLANDS).
