3 1. The general offences Paying bribes: it will be an offence to offer or give a financial or other advantage with the intention of inducing that person to perform a "relevant function or activity" "improperly" or to reward that person for doing so.

4 1. The general offences Receiving bribes: it will be an offence to receive a financial or other advantage intending that a "relevant function or activity" should be performed "improperly" as a result.

5 2.Bribery of foreign public officials A person who bribes a foreign public official is guilty of an offence if he intends 1.to influence the official in his official capacity, and 2.to obtain or retain business or an advantage in the conduct of business

6 3.Failure of commercial organisations to prevent bribery A new offence which can be committed only by commercial organisations.

7 3.Failure of commercial organisations to prevent bribery A person associated with a relevant commercial organisation bribes another person intending to obtain or retain a business advantage. The organisation cannot show that it had adequate procedures in place to prevent bribes being paid.

8 Extra-territoriality any British national or any British corporate or any person ordinarily resident in the UK regardless of where the relevant act or omission took place

9 Extra-territoriality anyone if any relevant act or omission took place within the UK

10 Extra-territoriality any commercial organisation with a presence in the UK regardless of where the relevant act or omission took place

11 Penalties imprisonment of up to 10 years unlimited fine
